Actions taken by the BiH Central Election Commission on the public vacancy published on March 29, 2020 in the advertisement part of the Official Gazette of BiH no. 18/20

The Central Election Commission of Bosnia and Herzegovina held its 13th session held on April, 2020 adopted a conclusion according to which it will submit the response of the BiH Central Election Commission to the request signed by Ms. Borjana Krišto as President of the Commission for the Selection and Appointment of the Members of the BiH Central Election Commission (hereinafter: the Commission) of March 31 2020.

As the request requires compliance with the law and decisions of the Commission issued prior to the entry into force of the Decision on the election and taking of the office and termination of duties of the members of the Central Election Commission of Bosnia and Herzegovina (Official Gazette of BiH No. 18/20), i.e. before March 11, 2020 and respecting the foregoing fact and acting in accordance with Article 2.6a of the Election Law of Bosnia and Herzegovina, the Central Election Commission of BiH is legally and virtually unable to participate in the implementation of the decisions of the Commission. In this regard, it should be noted that the BiH Central Election Commission did not publish the Public vacancy for the election and appointment of a total of five (5) BiH Central Election Commission members through the media, nor did it publish it on its official website. Also, the BiH Central Election Commission has not published on its official website the application forms for the competition, nor is it able to receive applications for the public vacancy in question. Any different action by the BiH Central Election Commission would be contrary to the Decision on the election and taking of the office and termination of duties of the members of the Central Election Commission of Bosnia and Herzegovina (Official Gazette of BiH No. 18/20 (Official Gazette of BiH No. 18/20), which entered into force on March 11, 2020 and in that regard relevant provisions of the BiH Election Law.

 

The BiH Central Election Commission, as an autonomous, independent and impartial body, continues to exercise its rights and duties in accordance with the Constitution, law, its rules of procedure and other regulations, and is committed to the activities within its competence, the most relevant of which are related to preparatory activities and the adoption of appropriate acts and decisions regarding the Local Elections scheduled for 2020.
